Devyani Khobragade approaches US court demanding dismissal of Visa fraud case
Diplomat Devyani Khobragade has moved to a federal court seeking the dismissal of the Visa fraud case that was slapped on her. She claims that there is no personal jurisdiction as she had been promised full diplomatic immunity by US Department of State.
Lawyer of Khobragade, Daniel Arshack recently submitted a motion of four pages seeking US court to dismiss legal action against his client due to lack of personal command and jurisdiction. The motion was thrown by Daniel on January 9, 2014 in front of Magistrate Judge Sarah Netburn at the Southern New York district.
Devyani was indicted for making false statements and visa fraud but came back to India on January 9 from John F. Kennedy airport. Before departing, diplomatic immunity was given to her by the State Department. Henceforth, she decided to leave for India and then approached a US court once again for dismissal of visa fraud case.
